Why this cover

WIBA is a no-fault statutory benefit — every employer must compensate an employee for a work-related injury or illness, capped at a maximum of 8 years' salary, whether or not anyone was at fault. Employer's Liability is different: it responds when an employee (or their family) sues you directly, alleging the injury was caused by your negligence — a claim with no statutory time limit and no cap. This cover meets your WIBA obligation and protects you against the Employer's Liability claims that go with it, so neither cost falls on your business directly.

Common terms

WIBA

The Work Injury Benefits Act (2007) — Kenyan law requiring every employer to compensate employees for work-related injury, illness, or death, regardless of fault, capped at a maximum of 8 years' salary.

Employer's Liability

Also called Common Law Liability — cover for claims where an employee alleges their injury was the employer's fault. Unlike WIBA, there's no statutory cap and no time limit on bringing a claim.
